I’m a doctor currently working in Dubai. I started a new job about one month ago, but I’ve recently received a better offer from another employer.
My question is: Can I legally resign and leave this job so soon after starting, or are there penalties or restrictions under UAE labor law?
I’d like to understand what the proper notice period is, whether my current employer can take legal action, and if this could affect my visa or future employment in the UAE.
I am Mr Sami Hassan, legal advisor staying in Dubai.
Dr Mohammed, under UAE labor law, you are legally entitled to resign from your job even if you have only recently joined. However, you must comply with the notice period stated in your employment contract (commonly 30 days, but it can vary). If you leave without serving the required notice, your employer may claim compensation equivalent to your salary for the notice period.
Your employer cannot prevent you from resigning, but they can enforce contractual obligations. As for your visa and future employment, once you resign properly and your visa is cancelled, you are free to take up new employment. In rare cases, if you breach the contract (e.g., leaving without notice), the employer could request a labor ban, but this is not automatic and depends on the circumstances.
